TERMS AND CONDITIONS

The following terms and conditions (as may be amended or modified) (“Terms”) govern the issuance, use and other activities, transactions and dealings involving the Gift A STARVoucher Programme (“the Programme”) organised by CapitaLand Retail Malaysia Sdn Bhd (“the Organiser”).

The following terms and conditions (as may be amended or modified) (“Terms”) govern the issuance, use and other activities, transactions and dealings involving the Gift A STARVoucher Programme (“the Programme”) organised by CapitaLand Retail Malaysia Sdn Bhd (“the Organiser”).

1.    Organiser & Eligibility

1.1  The Programme is open to all CapitaStar members (“Member”) in Malaysia, who have a valid CapitaStar account.

1.2  Member(s) is deemed to have accepted and agreed to these Terms if he/she uses or carries out any activity or transaction or makes any dealing involving a STARVoucher (“STARVoucher”).The Organiser has the sole discretion to exclude any Member from participating in the Programme without any obligation to furnish any notice and/or reason.

2.    Duration

2.1  Subject to the validity period of the Voucher stated in 4.8 below, the Programme runs from time to time as determined by us, in our sole discretion . The Organiser reserves the right at any time to change the duration and/or the commencement and/or expiry date of the Programme for any reason whatsoever as we deem fit.

3.    How it Works?

3.1   Step 1 : Member logs onto https://www.capitastar.com/my/en/starvoucher/about-starvoucher.html to fill in the Gift A STARVoucher Programme form (“Form”). As a condition of your request to participate in the Programme, you are required to provide us with current, accurate, truthful and complete information about the recipient  who will be receiving the StarVoucher (“Recipient”). We may reject any of the Member’s request as being invalid at our sole discretion, and any such decisions by us shall be considered final, conclusive and binding upon you;

3.2  Step 2 : Member will receive an email from ask_us@capitastar.com.my for verification and confirmation purpose in respect of the your request.  The Member requires to reply by proving us with a confirmation email.  Upon the Organiser’s receipt of the abovesaid Member’s confirmation email, the Organizer will proceed your request within reasonable time;

3.3  Step 3: The Organiser will check the Member’s account to ensure sufficient STAR$ to be deducted from Member’s account. For clarification purpose, STAR$ means the points awarded under the Programme;

3.4  Step 4 : The Organiser will send the STARVoucher to the valid Recipient within 3 working days or such extended time as the Organizer may require upon receiving confirmation email from the Member;

3.5  Step 5 : Recipient shall receive an email with a reward code. Recipient must be a CapitaStar member before utilising the reward code to claim the STARVoucher;

3.6  Step 6: Recipient enter the reward code in the mobile application created in connection with the Programme for CapitaStar members (“CapitaStar App”), in particular, under “Reward Code” section to claim the STARVoucher;

3.7  Step 7 :The STARVoucher will be stored at My Voucher tab in the CapitaStar App; and

3.8  Step 8 : Recipient can redeem the STARVoucher at the participating outlets (“Participating Outlets”). For clarification purpose, participating outlets means the qualified outlets, merchants or retailers in the Programme, as determined by the Organiser from time to time.

4.    STARVoucher

4.1  The STARVoucher may be issued in digital form and be stored on and made available through the CapitaStar App. 

4.2  The STARVoucher can be used at any of the Participating Outlets. Member(s) may refer to the list of participating outlets available on the respective mall’s website or CapitaStar website. Member(s) are advised to check directly with the participating outlets on the acceptance of the STARVoucher before making any purchase.

4.3  Member may use the STAR$ accrued in his/ her  CapitaStar account in order to redeem the STARVoucher and send it as gift to a Recipient as determined by such Member pursuant to the steps stipulated under Clause 3 above. However, Member is strictly not allowed to send the STARVoucher to his/her own account, for the purpose of clarification, the STARVoucher is intended to be a gift for a designated Recipient, and not for member’s personal consumption.

4.4  The STARVoucher denominations is as follow:

  • Every 2,000 STAR$ is eligible for one RM10 STARVoucher

4.5  The STAR$ deducted are not refundable. We may cancel and/or delete and/or otherwise deduct STAR$ that have already been credited into your account in our absolute discretion.

4.6 STAR$ accrued in a Member’s account remain our property. STAR$ do not entitle a Member to a vested right or interest and have no cash value. STAR$ are not redeemable for cash and are not transferable or assignable for any reason or any purpose.

4.7 STAR$ in your account are voided upon cancellation or termination of your membership, howsoever caused. For the avoidance of doubt, you shall not be entitled to any compensation in respect of any STAR$ which are voided.

4.8  Recipient(s) may redeem the STARVoucher through the CapitaStar App. The Recipient(s) must first:

(a) have agreed to the CapitaStar Terms &Conditions and these Terms;

(b) use the latest iOS, Android or Huawei versions of the CapitaStar App; and

(c) have a valid membership in the CapitaStar Rewards Programme.

4.9 Redemption of STARVoucher is limited on a first come, first served basis. Once the redemption limit is met, any Form submission under this Programme will no longer be processed.

4.10 Upon redemption of the STARVoucher, the STARVoucher shall only valid for one (1) month from the date the said STARVoucher is being redeemed or it shall expire on the last day of that quarter (whichever is applicable) subject to the Organiser’s right to dictate the expiry date of such STARVoucher as the Organizer may deem fit from time to time.

4.11 The Organiser shall not entertain any request made to extend the validity of any STARVouchers which have expired.

4.12 The STARVoucher is not exchangeable for cash and could only be used at the Participating Outlets. In order to use the STARVoucher for a transaction with a Participating Outlet, Member must scan the QR code from the Participating Outlet’s device at the payment counter/ point, or such earlier time as such Participating Outlet may require .

4.10 Each STARVoucher may only be used by the Recipient towards the payment for goods and/or services purchased from the Participating Outlet at our malls.

4.11 All payments made using the STARVoucher(s) are not entitled to any refunds between the Recipient and the Participating Outlets.

5      Member’s Information

5.1  Member hereby agrees to the Organiser to deduct STAR$ that match the value of STARVoucher that he/she has redeemed.

5.2  Member is responsible to provide genuine and accurate information upon submission of the Form.

5.3  The Member’s email address must be the same as the registration email address in CapitaStar App. If the said email address is different, Member needs to update the email address prior to the Form submission. Failing which, the Organiser would not be able to process the Member’s request to send Gift A STARVoucher to the Recipient.

5.4  If the transactions listed in the Member’s account are found to be false i.e the purchase receipts submitted do not belong to the Member, the Organiser reserves the right to refuse the Member’s request for this Programme without further notice to the Member.

6      Anti-Corruption

6.1  The Member acknowledges that the group of which the Organiser forms part is committed to conducting its business in an ethical manner and expects all its employees and parties with which it has a contractual relationship to conduct themselves with high ethical standards and to comply with applicable laws for the suppression of corrupt practices (“Anti-Corruption Laws”).

6.2 The Member, represents and warrants that, to the best of its knowledge, neither it nor any person who (by reference to all relevant circumstances) performs services or acts for or on behalf the Member  in any capacity (including, without limitation, employees, agents, related corporations, and subcontractors) (“Representatives”) has contravened, or procured or encouraged third parties (including, for the avoidance of doubt, the employees or any person acting on Organiser's  behalf) to contravene any Anti-Corruption Laws in connection with the Agreement. 

6.3 The Member shall immediately notify the Organiser if, any person employed by the Organiser or acting on the Organiser's behalf or any of Member’s Representatives, has contravened or attempted to contravene any Anti-Corruption Laws in connection with the Agreement, and shall take adequate steps to protect the interests of both Parties. All notices to Organiser in this regard should be sent to the Head of Group Internal Audit of CapitaLand Limited at the following email address  Whistleblowing.ACChair@capitaland.com.

6.4 The Organiser shall be entitled to terminate this Agreement forthwith if the Member or any of its Representatives has contravened or attempted to contravene any Anti-Corruption Laws, whether in connection with the Agreement or otherwise. Such termination shall be without prejudice to the Organiser’s other rights and remedies whether under the Agreement or otherwise.

7.    Right of Organiser

7.1  By participating in the Programme, the Member(s) are deemed to have accepted and agreed to be bound by the Terms and Conditions and any other instructions that the Organiser and/or its affiliates may issue from time to time.

7.2  The Organiser and/or its affiliates reserve the right to withdraw, postpone or cancel the Programme, and to amend or change the Terms and Conditions at any time for whatever reason and without giving prior notice to the member. The decision of the Organiser and/or its affiliates on all matters relating to and/or in connection with the Programme are deemed final and conclusive. By your continued participation of the Programme, you agree to be bound by the Terms and Conditions as amended from time to time.

7.3  Any terms and conditions applicable to the Programme which is illegal, prohibited or unenforceable under any law or regulation shall be ineffective to the extent of such illegality, voidness, prohibition or unenforceability without invalidating the remaining provisions.

7.4  These Terms and Conditions are governed by and construed under the laws of Malaysia.

8.    Personal Data

8.1  By entering this Programme, the Member(s) hereby agree that the Organiser, its related and associated companies, and its agencies and companies associated with the Programme may collect, obtain, store and process Member’s personal data that has been provided for the purpose of receiving updates, news, promotional and marketing mails or materials from the Organiser.

8.3  By completing and submitting the Form, the Member represents undertakes and confirms to the Organiser the following:

a) The Member has obtained consent from the Recipient to disclose his/her details including but not limited to the Recipient’s name, address, phone number, email address (including such necessary details as may be reasonably required) to the Organiser;

b) The Recipient has no objections to the Organiser contacting them for the purpose of this Programme and the Member shall be solely responsible for the consequences of providing such details of a Recipient;

c) The Member and the Recipient are deemed aware and have read and understood the Organiser’s Personal Data Protection Policy at https://www.capitaland.com/en/legal-notices/privacy-policy.html; and

d) By participating in the Programme, the Recipient is deemed he/ she has agreed and consented for his/her details to be collected, used, disclosed and/ or processed for the purpose of this Programme.

8.3 Examples of Member’s Personal Data which may be collected, used, disclosed and/or processed for the Programme include the following:

a)  name, CapitaStar ID, email address, and any other information relating to member which have been provided consent to the Organiser through forms or in other forms of interactions between the two parties;

b)  information pertaining your usage and interaction with the products and services under the Programme and/or the Programme’s Website including traffic to and from Programme Website and/or

c)   photographs or audio-video or other recordings that has been taken in connection with the Programme.

8.4  Notwithstanding the content of Clause 8.1, the Organiser would have the consent of the Member in relation to the Programme to collect, use, disclose and/or process Member’s personal data for the following purposes strictly in relation to the purposes of the Programme:

a)  responding to Member’s queries, requests and/or feedbacks.

b)  sending Member’s notifications as well as marketing and promotional messages under and in relation to the Programme (including SMS and e-mail) such as information, updates and/or advertisements and/or other communications in connection with the process of the Programme.

c)  carrying out profiling and statistical analysis to improve the Programme.

d)  compliance with any applicable rules, laws and regulations, codes of practice or guidelines or to assist in law enforcement and investigations by relevant authorities.

8.5  In addition to clause 8.1 and 8.2, Member(s) hereby agree to provide consent for the collection, use, disclosure and/or processing of personal data by the Organiser and its marketing partners and/or authorized service providers for the following purposes:

a)  communicating and providing services including offers, advertisements, promotions or activities conducted at any of the Organiser’s property in relation with the Programme.

b)  matching Member’s personal data with other data collected for other purposes and other sources in connection with the provision of the Programme whether by the Organiser or third parties that are in direct relation with the Organiser.

c)  administering and conducting the Programme on behalf of the Organiser including announcing the results of the Programme, identifying and contacting winners and publicising and conducting marketing related to the Programme.

d) sending you details of the Programme and Rewards.

e)  conducting consumer and market related research, understanding and determining customer preferences and demographics for the Organiser to review, develop and/or improved products, services and marketing communication activities.

f)   informing the Member via email, SMS and other means of communication about or in relation to the Programme.

8.6  Member(s) hereby agree that the consent granted herein do not supersede or replace any other consents that have been previously granted to the Organiser in respect of Personal Data for the collection, usage, disclosure and/or processing.
